By accessing and using erickquijada.com (the "Website"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Eligibility and User Conduct

  • Age Requirement: You must be at least 18 years old, or have the consent of a parent or legal guardian, to purchase products or book lessons on this Website.

  • Prohibited Behavior: You agree not to use the Website for any unlawful purpose. You are prohibited from attempting to bypass site security, uploading malicious code, or using "bots" to scrape content from the blog or store.

  • Account Security: You are responsible for maintaining the confidentiality of your password and account details. You agree to notify us immediately of any unauthorized use of your account. Erick Quijada cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. Intellectual Property

All content included on erickquijada.com, including but not limited to text, graphics, logos, images, classical guitar arrangements, sheet music (PDFs), video tutorials, course materials, templates, and digital books, is the property of Erick Quijada and is protected by international copyright laws.

  • 3.1 Limited License: When you purchase a digital product, course, or membership, you are granted a limited, non-exclusive, non-transferable license for your own personal, non-commercial, and educational use.

  • 3.2 Prohibited Uses: You expressly agree not to reproduce, redistribute, or sell any portion of the content; share digital download links or login credentials; or upload proprietary video content to public platforms (like YouTube).

  • 3.3 Performance Rights: Purchasing sheet music does not grant "public performance rights" for commercial broadcast or recording. For professional inquiries, please contact erickquijada.com directly.

  • 3.4 User-Generated Content: If you post comments, photos, or videos of your playing to the Website, you grant erickquijada.com a perpetual, royalty-free license to display this content. We reserve the right to remove any content we deem inappropriate.

4. Payments & Subscriptions
​

  • 4.1 Accuracy: You agree to provide current and accurate purchase information. Prices are subject to change without notice.

  • 4.2 Automatic Renewal: All membership subscriptions automatically renew at the end of your billing period (monthly or annually). To avoid future charges, you must cancel through your account settings before the renewal date.

  • 4.3 Taxes: You are responsible for any sales tax or VAT applicable to your jurisdiction.

5. Refund & Cancellation Policy
​

  • 5.1 Digital Products: Due to the immediate delivery of digital content, all sales of downloadable products (such as PDF sheet music, e-books, and digital materials) are final and non-refundable once download access or delivery is granted.

  • 5.2 Individual Private Lessons (In-Person & Online):

    • Rescheduling: You may reschedule a scheduled private lesson at no additional fee up to 48 hours prior to the start time via your online student account or by written notice to support@erickquijada.com. Rescheduling requests submitted within 48 hours of the appointment cannot be accommodated.

    • Timely Cancellation: Cancellations submitted at least 48 hours prior to the start time receive a 75% refund processed in CHF to the original payment method (Stripe or TWINT). The remaining 25% is retained to cover non-refundable merchant transaction fees and administrative scheduling costs.

    • Late Cancellation & No-Shows: Cancellations made less than 48 hours before the start time, or student absences (arriving 15+ minutes late), receive no refund or rescheduling credit and forfeit full session tuition.

  • 5.3 Recurring Monthly Memberships (Founding Cohort & Standard Pass):

    • Billing & Renewal: Memberships bill automatically every 30 days in CHF until canceled. You may cancel your subscription at any time through your student portal prior to the next renewal date. Unused portions of active billing cycles are non-refundable.

    • Session Scheduling within Memberships: Monthly lesson slots are subject to the same 48-hour rescheduling notice requirement. Missed sessions or late cancellations do not roll over to subsequent months and are forfeited.

  • 5.4 Performance Bookings: Concerts, masterclasses, and corporate performance services are governed exclusively by a separate, signed service agreement and are exempt from this general policy.

6. Limitation of Liability & Disclaimer
​

To the maximum extent permitted by law, Erick Quijada shall not be liable for any damages resulting from the use of the Website, technical down-time, or musical practice-related injuries.

​

  • Disclaimer: Musical progress depends on individual effort. We do not guarantee specific results or "fame" from following these tutorials.

7. Indemnification

 

You agree to defend, indemnify, and hold harmless Erick Quijada from any claims, damages, or expenses (including attorneys’ fees) arising from your use of the Website or your violation of these Terms.

8. Right to Modify and Termination

 

We reserve the right to revise these terms or terminate your access to the Website at any time, without notice, for conduct that violates these Terms or is harmful to our interests.

9. Governing Law

 

These terms are governed by the laws of Basel, Switzerland, and you submit to the exclusive jurisdiction of the courts in that location.
